DMCA Copyright Policy
Moussaka (the "Site") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our designated Copyright Agent.
This policy outlines the information required to submit a proper notice of infringement and how we handle such notices. It also explains the process for submitting a counter-notification if your content has been removed due to a copyright complaint.
Filing a DMCA Notice of Infringement
If you believe that your copyrighted work has been copied and is accessible on Moussaka in a way that constitutes copyright infringement, you may submit a written DMCA Notice of Infringement to our Copyright Agent with the following information:
- Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: Provide a description of the material that you claim is infringing and its location on Moussaka. This must be specific enough to allow us to locate the material (e.g., a direct URL to the infringing content).
- Contact information of the claimant: Include your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy and authority: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Once a complete and valid DMCA Notice of Infringement is received, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled, you have the right to submit a DMCA Counter-Notification. A valid Counter-Notification must include the following:
- Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Moussaka may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid Counter-Notification, we will send a copy of the Counter-Notification to the original complaining party. If the complaining party does not inform us that they have filed an action seeking a court order to restrain you from engaging in infringing activity within 10 business days of receiving the Counter-Notification, we may restore the removed material.
